When Catastrophic Neurological Outcomes Are Not Malpractice: Understanding Risk in Neurocritical Care

LNCs sometimes equate poor neurological outcomes with potential malpractice, without fully understanding the inherent risk, variability, and unpredictability of an acute neurocritical illness. Learners will be able to distinguish between the unavoidable progression of challenging neurological diseases and true deviations from standards of care, thereby gaining additional knowledge to identify potential evaluation errors that could lead to medicolegal misclassification. Learners will also learn new information to identify high-risk neurologic conditions in which deterioration may occur despite appropriate medical management. Additional knowledge will be gained from analyzing case studies that discuss disease progression versus potential negligence.

Case Examples in Forensic Pathology Consulting
Eric Peters, MD
Following the presentation, Legal Nurse Consultants will acquire additional
and updated critical knowledge needed to effectively analyze and navigate the complexities of postmortem reports and death certification records. Nurses will become more adept at identifying and evaluating other key forensic records and documents, further educating nurses to assist medicolegal colleagues in the determination of meritorious personal injury, medical malpractice, and criminal legal cases. Updated information and presentation discussion will include when
nurses will better understand when a consultation by a forensic pathology specialist would be appropriate and beneficial to further assist with a legal claim.
